Terms of Service

These Terms of Service (“Terms”) govern your use of OutbidFans (the “Service”), operated by OutbidFans (“we”, “us”). By accessing the Service or completing a payment, you agree to these Terms, the Refund Policy, and the Privacy Policy.

If you do not agree, do not use the Service or make a purchase.

OutbidFans is a digital entertainment / browser game. Players pay to hold a temporary in-game crown on a selected country on an interactive world map (team name, colors/pattern, optional link) while holding the highest successful paid bid for that country.

• You buy a temporary in-game crown / map coloring status under these Terms as part of a competitive fan game — not land, sovereignty, citizenship, real property, advertising inventory, sponsorship packages, or government affiliation.
• OutbidFans does not sell ads, media placements, or brand sponsorship to advertisers. Optional links are player content inside the game, not paid ad slots.
• The Service is not gambling, not a lottery, not a prediction market, and not an investment or security. Results depend on published outbid rules and payment amounts, not chance.
• Country geography is illustrative only and may be simplified.

To claim a country you must pay at least the minimum bid shown at checkout (first claim or current winning bid plus the required increment). After a successful payment:

• Your team kit may appear as the current owner on the map for that country.
• If another user later pays a higher qualifying amount for the same country, they become the new current owner (“outbid”). Your prior payment is not refunded because of an outbid.
• Paid bids may remain listed in that country’s challengers list (including optional links you provided), even after you lose the crown. Challenger rows are a game feature, not a separate purchased advertising product.

We may correct display errors, remove abusive content, or suspend accounts that violate these Terms.

Prices are shown in USD at checkout together with the country being claimed. Payments are processed by a third-party Merchant of Record (e.g. Lemon Squeezy, Polar, or another partner we designate). That partner is the merchant of record for the transaction, handles payment processing, applicable sales taxes/VAT where required, and related customer payment support according to their terms.

A purchase is complete only after the payment partner confirms successful payment to us. Failed, cancelled, or fraudulent payments do not create ownership rights.

You are responsible for team names, nicknames, colors, patterns, and links you submit. You grant us a worldwide, non-exclusive license to display that content on the Service.

You must not submit or link to content that:

• contains profanity, harassment, threats, or hate speech;
• promotes illegal activity, exploitation, or violence;
• infringes intellectual property or impersonates others;
• contains malware, scams, or deceptive phishing;
• violates applicable law or these Terms.

We may filter, refuse, hide, or remove content and may revoke map display for violations without refund except where required by law or our Refund Policy.

We aim to keep the map available but do not guarantee uninterrupted uptime. We may change features, minimum bids, countries shown, or these Terms. Material changes will be posted on this page with an updated date. Continued use after changes means acceptance.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Map display is entertainment only and creates no real-world rights.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE OR A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC CLAIM TRANSACTION GIVING RISE TO THE DISPUTE.

Nothing in these Terms limits rights that cannot be limited under mandatory consumer law.

You agree to indemnify and hold harmless OutbidFans and OutbidFans from claims arising out of your content, your misuse of the Service, or your breach of these Terms.

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply and cannot be waived. Courts of Istanbul, Turkey shall have jurisdiction for disputes that are not resolved amicably, subject to those mandatory protections.
